III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one <br />represented the operator during the inspection. <br />Hydrology <br />Pond number 1 was dry. The gate on the primary tube was closed. Both the primayy and <br />emergency spillways were functional. The vegetation on the pond embankment was short <br />in height, due to the dry weather conditions. Pond inslopes and outslopes were <br />geotechriicallyand erosionally stable. <br />Pond number 2 was also dry. The silt fence in the dischazge channel was in place. There <br />was spazse vegetation on the pond embankment. The pond inslopes and outslopes were <br />stable. <br />Silt fence and straw bales were in place at the railroad track SAE. <br />Facilities <br />Coal haul trucks were unloading and coal railcars were being loaded during the <br />inspection. There were no problems with fugitive dust. The coal stockpile was of <br />moderate size. The pile was away from the outside edge of the facilities bench. <br />These were rio leaks at the fuel-facilify. The cbritainmeht berm was intact. - - - - <br />Topsoil <br />There were no signs of erosional gullys at the topsoil stockpiles. Collection and diversion <br />ditches were intact.
