ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ti+-798[5 <br />INSPECTION DATE: 4~1 ~ m7 INSPECTORS INITIALS: ~- <br />OBSERVATIONS <br />1) The Division conducted a pre-operational inspection of the site on 4/11/07. <br />2) Site is an existing 112 dewatering/slurry wall operation along the Arkansas•s river <br />flood plain, approximately 2 miles east of Pueblo on US Highway SO.Presnt during the <br />per-operational inspection were, Mark Klune, Clayton More and Ashley Bates of <br />Transit Mix. <br />3) Amendment to the permit was submitted 2/23/07.Amendmet proposes to increase the <br />affected acres by approximately 70 acres. Total permitted acres is 438.0 <br />4) Primary post mining land use is wild life habitat. <br />5) Amendment proposes to backfill most of the are, by utilizing was fines. Also <br />proposes to place a ground water barrier wall/slurry wall during the mining <br />operation, to prevent GW SEEPAGE. <br />6) Operator has submitted a warranty calculation for both envisioned plans. <br />7) Entire proposed affected area was inspected, amendment application sign properly <br />posted. <br />8) There were a few power lines, and an irrigation ditch located with in 200 feet of <br />the proposed affected area. Since there was no signed agreement between the owners <br />of the structures and the operator, included in the amendment application, the <br />Division informed the operator to either submit the agreement or not mine with in <br />200 feet or submit an engineering study to show that there will be no impact to <br />these structures. Operator agreed to provide the needed agreement prior to the <br />Division sending the adequacy comments. <br />9) As was the case in the previous mining area, operator has left a 100 foot set back, <br />between the River and the affected area. <br />10)The river breach from last years flood in the existing area was inspected. The 1000 <br />foot set back area used during the re-construction of the berm was in good repair, <br />according to Clayton, has been seed and the berm along the river has been placed <br />with concrete cover along the river side. Operator asked if they could place their <br />top soil pile in the amended area, as flood protection along the river side.
