<br />' III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />sediment at the point where Coal Canyon drainage enters the <br />Colorado River. The river itself was somewhat cloudy, apparently <br />from recent storm runoff at higher elevations, and any influence <br />from the minewater discharge was not visibly apparent. <br />Diversions, Impoundments, and Sediment Control Structures <br />With the exception of Pond 8, all sediment ponds and SAE sumps were <br />dry, and appeared to be well maintained and in compliance with <br />applicable requirements. Pond 8 water level was approximately 2 <br />feet below the tops of the sediment level markers, which are 5 feet <br />below the spillway channel elevation. The upper two cells of the <br />non-discharging sewage lagoon contained water, the lower two cells <br />were dry. <br />The containment berm near the South Portal guard shack has been <br />built up substantially as requested in the previous complete <br />inspection report. Grated drop inlet structures at the South <br />Portal upper bench and North Portal yard area across from Pond 5, <br />had also been cleaned out as recommended in that inspection report. <br />A short section of the drainage ditch along the northwest side of <br />the UTL coal stockpile, across from the sewage lagoon, has <br />accumulated a small quantity of coal fines, and maintenance is <br />necessary. <br />Backfillinq and Grading <br />Some new settling cracks were observed at the reclaimed North <br />Decline area, just to the west of the drainage channel, within an <br />area where settling cracks had been graded this past spring. The <br />operator indicated a dozer was scheduled for this month to rip the <br />area in preparation for seeding. The settling cracks should be <br />filled in at that time. <br />Processing Waste <br />Refuse was being hauled to CRDA-2 at the time of the inspection. <br />Most of the active bench at CRDA-1 had been graded out and <br />compacted, and a new bench has been started at the northwest end of <br />the pile. The CRDA-1 upper terrace ditch had been maintained as <br />requested in the previous complete inspection report. The seep at <br />the base of the reclaimed bench at the southeast end of the pile <br />where a small topsoil slump occurred earlier in the year is now <br />merely damp, its location highly visible due to salt crust on the <br />surface.
