,' (Page 21 <br />MINE ID # OR PROSPECTING ID # M-f11-158 <br />INSPECTION DATE 12-17-99 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This was a routine inspection, conducted as part of the Division's on-going monitoring program for active mine sites in <br />Colorado. <br />The site conditions are similar to those observed during the 1995 inspection, except that an additional area has been <br />excavated on the southeast corner of F'it No. 2. This added excavation area appears to have extended the portion of the <br />excavation that was noted in the 1995 report as possibly being located outside the approved permit boundary. The <br />corrective action due date for this problem, listed in the August 2, 1995 inspection report, was extended to allow the <br />operator to petition the Mined Land Reclamatipon Board for a declaratory order. The petition was heard and denied by the <br />Board on October 19, 1995. However, the corrective action was never completed. This also applies to the corrective <br />action requiring placement of permit boundary markers. These problems must be addressed as soon as possible. <br />As stated in the 1995 inspection report, the operator will need to provide documentation indicating the location of the <br />approved permit boundary in relation to the affected areas of this operation. If mining operations have affected areas <br />outside the approved permit boundary, an enforcement action may be taken. <br />Weed problems at this site appear to be under control, but continued annual control will most likely be necessary to prevent <br />an infestation of the site. <br />Pit No. 1 appears to be unchanged since the previous inspection. <br />Fill material has been brought into the pit and used for backfill of the highwalls. Per Rule 3.1.5191, prior to importation of <br />any material, a notice is required to be submitted to the Division Because of the use of imported fill for highwall reduction, <br />the operator must submit the required notice, for the material already imported, and for any material proposed to be <br />imported in the future. <br />Division policy calls for reclamation cast estimate's to be updated approximately every four years. The reclamation cost <br />estimate for the Forest Lakes Pit No. 1 was last updated in march of 1996. In the next few weeks, the Division will <br />recalculate the reclamation cost estimate for this site.
