The subsequent inspection report noted two potential <br />problems at the site. Item #1 addresses the presence of livestock. <br />Item #2 addresses the presence of wrecked vehicles. The latter of <br />these two issues has been addressed in previous correspondence with <br />the Division. At this time I would like to address Item #1. <br />Background <br />Elam Construction, Inc. holds a 112 permit (M-79-075! for a sand and <br />gravel mining operation located in Garfield County, known as the <br />Chambers Pit. The permit area consists of approximately 53.1 acres <br />which will potentially be affected by mining and reclamation <br />activities. Actual extraction will impact approximately 41 acres <br />through the life of the mine. The approved mine plan indicates a <br />phased operation. Stage 1 of the mining operation consists of some <br />21.87 acres. Approximately half of the available material in the <br />Stage 1 area has been extracted over the last 12 years. Completion of <br />mining in Stage 1 is not anticipated in the near future. The Stage 3 <br />area, per the approved mining plan is currently utilized for stockpile <br />and processing activities. Addi*_ionally, a small lake lies within the <br />Stage 3 area. This is the result of mining under a ill permit which <br />was subsequently converted into the present lit operation. <br />The right to extract gravel at this site is secured ti,rough lease <br />agreement. Throughout the term of the lease agreement the landowner <br />has retained the right to graze livestock on the leased area. The <br />MLR'i inspection report cites the following as a compliance issue: <br />"Livestock (sheen) were noted (observed) along the eastern <br />embankment o~ the lake. Operator should have these sheep <br />removed from the permit area." <br />The inspection report lists a compliance date of 5(13/92 for the above <br />mentioned corrective action. <br />
