~i <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of Colorado DMG. Basil Beaz <br />represented the operator. The mine site has received a fair amount of precipitation in the <br />last couple of weeks. The mine has been idled, although the loadout is still being used for <br />Bowie No. 2 coal. <br />Siens and Markers <br />Mine identification signs were up at the required locations. The information on the signs <br />was correct. Topsoil signs were also up at the topsoil stockpiles. <br />Facilities <br />The operator has eliminated the upper coal stockpile and nearly all of the lower coal <br />stockpile at the loadout. A little coal was being tracked onto the highway from the <br />loadout due to the intermittent wet weather conditions, but it did not appeaz to be enough <br />to cause any problems. Coal haul trucks were unloading and no problems with fugitive <br />dust were observed. <br />The operator stated that a citizen had informed the mine that there was some smoldering <br />coal at the highway temporary coal stockpile. The operator spread out the smoldering <br />coal with a front end loader. This put out the smoldering. There also was a very small <br />amount of smoldering coal on the crusher\screener bench. <br />There were no problems noted at any of the facilities. The operator had dismantled the <br />first 100 feet of conveyor line coming out of the main portal, for use at the Bowie No. <br />Mine. The non-coal waste in the concrete collection bin at the tire shop had been <br />removed. All of the barrels have been removed from the barrel storage area above the <br />waste oil tank facility. The oil sump at the shop\warehouse was full of water and <br />dischazging, but no oil or oil sheen were observed. <br />1 <br />
