III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DBMS. No one represented the <br />operator during the inspection. There was no snow cover at the mine site. <br />Roads <br />The road up Hubbard Creek was passable. There were some deep ruts in the road but the road was frozen early <br />in the morning. The graveled mine road across Hubbard Creek was in good condition. The mine gate was open. <br />The access road to Pond 4 was wet in spots but was passable. <br />Signs and Markers <br />The mine ID sign was on the mine gate, as was the "records location" sign. Surface disturbance markers <br />delineated the disturbed area. <br />Reclamation <br />The backfilled and graded reclaimed slopes appeared to be stable. There were no indications of slope instability <br />or erosional problems. The vegetative cover was good. <br />No problems were observed with the reclaimed road. <br />Hvdrolo~ <br />There was no standing water on the reclaimed benches. <br />Pond 5, located west of Hubbard Creek, had no standing water, snow or ice in it. There was a lot of vegetation in <br />the pond. The pond embankment was stable and the pond spillways were functional. The upland diversion ditch <br />and culvert that bring surface runoffto Pond 5 were in order. <br />There was about one foot of standing water in Pond 4. The discharge structures for Pond 4 were operational. <br />The gated primary valve was closed. The pond embankment appeared to be stable. The collection ditch leading <br />into Pond 4 had sufficient capacity. Also, the black pipe that brings bench water down to Pond 4 was in place. <br />There was no discharge from any of the underdrains. The Hubbard Creek culvert was functioning properly. <br />Records <br />The mine records are located in the Delta County Courthouse. As shown on the attached records checklist, the <br />records were in compliance <br />c:/word/blueribbon/insp 1006 <br />
