. .- <br />111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by DMG staff from the <br />DMG Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone <br />(970) 247-5469. Ross Gubka accompanied the DMG inspector throughout the <br />inspection. <br />Mine identification sign and permit boundary markers were posted. Water trucks were <br />spraying the haul and access roads and ramps within the permit area. <br />Construction of temporary road BB is complete. The operator indicated that portions of <br />the road may require additional minor improvements. The road is being utilized by the <br />public. <br />Pit area was active. Reclamation backfill, grading, topsoil salvage and topsoil <br />replacement appeared current. Irrigation equipment was intact for reclaimed areas. Pit <br />drainage was being pumped to a sediment containment ditch which discharges to Pond <br />007. Pond 007 was discharging through its primary spillway. <br />
