Compliance with Colorado Srzz•__'ace Coal :Yining Reclamation act <br />CRS Z97J, as amended J4-33-SO_', et. sea., <br />a.~td the <br />Ru_'es and ReCUlat=ons Issued 2vrsr:ant to G4e act <br />Phis includes a listing of the particular provisions of the regulatory program which were <br />examined during rye course of this inspection, and identifies enforc=went actions taken <br />during ;1~e inspection for .'allure to comply wit9 the Rules and Regulaticns, the Act and <br />the permit. <br />4.02 Signs and Markers <br />Signs and markers were appropriately placed and displayed the proper information. <br />4.03 Roads <br />No erosional problems were evident along the road. The pile of road scracing <br />at the inlet to culvert-J was partially removed in March. The mmainder of the pile =houZd <br />be moved as soon as road conditions permit. <br />9.05 Hydrologic Balance <br />Cuvlert C-3 ~,ras clear and functioning. In order to reduce m,~intenance at this <br />location, the operator proposes to install a '~ culvert covered by screening to replace <br />the full culvert. This culvert location has been a recurring prcUlem because of tine <br />lack of necessary gradient for the culvert to function properly. This change in methodology <br />should be reflected in the current permit application. <br />The sediment pond water level was approximately 18" hel oir the den~a terinr, <br />devise. No discharges had taken place. <br />9.06 Topsoil <br />No topsoil is stockpiled on-site. <br />4.07 Sealing of Underground Openings <br />We discussed the sealing of the Apex 1JO. I portal at the time of reclamation. <br />After removal of the fan from the bench, the drainage must be restabilized and reclaimed. <br />4.08 Explosives <br />No explosives are used on the surface. <br />9.09 Disposal of Underground development Waste <br /> <br />Waste is disposed of underground in mined out areas. L'o substantial am^unt <br />of underground development waste will be generated until the decline into the shirr <br />fault block is started.. <br />9.12 Slides <br />Some small rock falls have occurred near the portal face-up with ne resu.Ltant <br />environmental damage. <br />
