III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete inspection of the McClane Canyon Mine, conducted by Dan Mathews of the DRMS Grand <br />Junction Field Office. I checked in at mine office prior to the beginning of the inspection, and Chuck Silengo of <br />MCM was contacted during the the inspection, but I was not accompanied by an operator representative during <br />most of the inspection. Weather was partly cloudy, very warm, and relatively humid. Ground conditions were dry <br />in most areas, although there was evidence of recent flow in various diversion and collection ditches, and the <br />sediment pond was nearly full from combination of storm runoff and drainage from road watering. Coal was <br />being conveyed out of the mine and loaded onto trucks during the inspection. <br />Signs and Markers <br />The Division recently approved permit transfer from CAM Mining LLC to McClane Canyon Mining LLC (MCM). <br />The Mine I.D. sign still lists CAM Mining LLC as the permittee. Mine I.D. signs needs to be properly updated <br />to list McClane Canyon Mining LLC as the permittee. <br />Availability of Records <br />Required records were on file and up to date through the 2nd quarter, 2007. <br />Roads <br />Haul Road surface, ditches, and culverts were generally in good condition, and had recently been watered to <br />suppress dust. <br />The inlet sump to Culvert "K", the 12" CMP at the lower end of the storage area north of the sediment pond inlet <br />was filled in with sediment to the culvert inlet level. Also minor sediment accumulation at the inlet end of the <br />culvert. The sump needs to be excavated and sediment placed in the approved sediment drying location. <br />The inlet end of the culvert pipe needs to be cleaned out. <br />The "in-ditch" sump is full of sediment and needs clean-out. <br />Silt fence sediment traps along the lower haul road are silted in and need to be maintained. <br />Hvdrolooic Balance <br />There was a trickle of flow in East Salt Creek at the time of inspection. There was no flow in McClane Creek, but <br />there was evidence of significant recent flow in the creek and in various permit area ditches. Operator reported <br />that there had been several rains since early August at the mine site. <br />The sediment pond was nearly full of water; surface elevation was approximately 12 to 16 inches below the <br />emergency spillway invert, and well above the gated primary spillway elevation. The pond needs to be <br />dewatered down to the primary spillway elevation as soon as can be accomplished in accordance with <br />CDPS discharge requirements. Discharge will need to be sampled and reported as required by CDPS <br />permit. The pond embankment appeared to be stable, with no indication of seepage, cracking, or slumping. <br />SAE silt fences were intact and functional. <br />3 <br />
