III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br />Dave Wallace (Wallace) of Twentymile Coal Company (Twentymile) accompanied Byron Walker (Walker) <br />of the Colorado Division of Minerals and Geology (Division) during this inspection. Joe Shoemaker and Bob <br />Johnston, both of Twentymile, were contacted for specific information. Afrer the joint inspection, and as <br />discussed with Wallace, samples were taken at various locations outside the permit area from streams in the <br />region and tested for conductivity, pH and temperature by Walker. Results aze attached. <br />Items of concern from previous inspections include the following: <br />• uniformity of markers that delineate the perimeters of areas affected by surface operations. See a discussion <br />under Signs and Markers below. <br />• clearly indicating boundaries of areas authorized for disturbance on maps of the Permit Application Package <br />(PAP). See a discussion under General Mine Plan Compliance below. <br />• an approved design of the sediment control measure for the temporary belt structure storage area. See a <br />discussion under Hydrologic Balance below. <br />• an approved design of the sediment control measure currently in place for the CYCC office area. See a <br />discussion under Hydrologic Balance below. <br />• an approved design of the sediment control measure for the "Trudy's" corner storage and training azea. See a <br />discussion under Hydrologic Balance below. <br />• protection of the topsoil storage pile at the North West Mains Ventilation Shaft. See a discussion under <br />Topsoil below. <br />• maintenance of the sediment control measure at the # 7 North Escape Shaft. See a discussion under <br />Hydrologic Balance below. This work had been accomplished at the time of this inspection. <br />AVAILABILITY OF RECORDS <br />All required records were on file. See the DMG Availability of Records check sheet attached. There are a <br />number of documents in the public information file at the Routt County Courthouse that are outdated and <br />could be removed. Walker removed outdated documents generated by the Division. <br />SIGNS AND MARKERS <br />Markers (Rule 4.02.3) delineating the perimeters of areas affected by surface operations or facilities were in <br />place. A description of such markers is found on page 2.05-12 of the PAP (posts with bright fluorescent paint, <br />orange surveyor mazkers, or fenced). Some mazkers have weathered. Markers need to be of uniform design <br />[Rule 4.02.1(2)]. This item was first identified in the inspection of July 12, 2004. Twentymile is in the process <br />of refurbishing some markers, and is considering uniform design options. <br />The identification sign at the entrance off Routt County Road 27 into the satellite warehouse/storage azea <br />(vicinity of the Routt county Roads 27 and 33 intersection) needs to be restored (PAP page 2.05-19). <br />Previous buffer zone signs were in place and new buffer zone signs were up at the 18-Right Ventilation Shaft <br />work in the vicinity of Fish Creek (see picture under TOPSOIL below). <br />C-1982-056.
