(Page 2) <br />MINE ID # OR PROSPECTING ID #: rtn_~rtttt_nR5 <br />INSPECTION DATE: yJ1t,CL13 INSPEC70R=S INITIALS: a iw <br />OBSERVATIONS <br />This was afollow-up inspection to apre-operational inspection which was conducted by Tony Waldron of DMG <br />along with Les Ewegen of 124th Estates Partners. The inspection was conducted to follow up on a potential <br />problem that was observed during the pre-operational inspection. The site is located just west of U.S. Hwy 85 <br />and in between 124th Avenue and 120th Avenue near Henderson, Colorado. There are numerous gravel pits in <br />this area mining the gravel rich alluvial terrace of the Platte River. This pit is situated approximately one mile <br />east of the river on a more upland terrace. The active portion of the site was mined and reclaimed by a <br />previous operator, however, a substantial amount of gravel was never mined before the market soured and <br />the mine was reclaimed. As a result, the current operator decided to re-open the site and complete the <br />mining before reclaiming the pit to a water storage reservoir for the City of Brighton. <br />The areo of concern is whether or not the operator is maintaining a 1.5H:1 V slope on the perimeter of the pit <br />while conducting mining operations. During the permitting of this site, the stability of the pit walls during mining <br />came into question. The operator agreed to do one of two things to alleviate the concern. The first was to <br />maintain at least a 40 foot set-back from the top of the slope to the nearest protected structure and the <br />second was to mine the slopes at no steeper than 1.5H:1 V. At this site there are at least three structures of <br />concern including U.S. Hwy 85 to the east, residential structures on the north, and the Fulton Ditch on the west. <br />During the pre-operational inspection conducted in conjunction with an amendment for expanding the <br />permitted area, it was noted and conveyed to the operator that the perimeter walls of the pit appeared to be <br />steeper than 1.5H:1 V. However, it was not possible to measure the slopes at that time. Therefore, this inspection <br />was scheduled to follow-up on this activity. The results indicated that the north perimeter wall slopes exceeded <br />the 1.5H:1 V restrictions. It should also be noted that it appeared that these slopes had been backfilled recently <br />with gravel/overburden material. In addition, the east wall was right at 1.5H:1 V and the south wall was also <br />slightly steeper than 1.5H:1 V .
