III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments rnclude discussion of observations made <br />dunng the inspection. Comments also descnbe any enforcement acLOns taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of <br />Reclamation, Mining. and Safety (Division). Oblique aerial photographs were taken and <br />reviewed in the office on January 19. 2007 by Kent Gorham of the Division. This processing <br />and loadout site has been inactive since June 2001 after the closure of the Lorencito Mine <br />(#C-96-084). An application for transfer the permit was initially approved but that approval <br />was rescinded and is currently pending awaiting resolution of bonding issues that developed <br />after the approval was granted. Heavy snow blankets the region due to numerous snow <br />storms that have hit the area in the last month. <br />Roads were snow-covered and <br />but rt appears that the operator <br />has cleared snow from many of <br />the access roads at the site. No <br />activity at the site was apparent <br />on this day. Ponds were snow- <br />covered but it was evident that <br />the frozen water level was well <br />below the lowest discharge point <br />in both pond 7(facility area) and <br />pond 6(RDA). Pond 4 appeared <br />snow-covered but generally dry <br />as normal. <br />The Refuse Disposal Area <br />(RDA) was snow-covered and no <br />evidence of runoff, slides or <br />damage was noted in the <br />photographs taken. <br />Overall, nothing warranting on- <br />the-ground inspection was noted <br />in any of the photographs taken. <br />
