III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br />describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br />On April 21, 1999, William J. Carter, Dan Hernandez, Larry Routten, and Joe Dudash from the Division of Minerals and Geology, <br />accompanied by Kathleen Welt and Tom Anderson representing Oxbow Mining, Inc., performed a complete inspection of Sanborn Creek <br />Mine. The weather was clear and warm during most of this inspection. <br />At this time the mine is still not operating due to the fire. Two portable fans are operating at the main portal through the fan shaft to add <br />fresh air to the portion of the mine that has been reopened. The main portal has been opened to allow for recovery efforts. The soil has <br />been removed from in front of the conveyor portal. However, the conveyor portal remains closed at this time. <br />After April 30, 1999 William J. Carter will retire and at that time Blue Ribbon Mine will become the responsibility of Jim Burnell. All <br />communications should be directed to Mr. Burnell. <br />Availability of Records: <br />See "DMG Availability of Records" attached <br />Signs and Markets: <br />Roads: <br />Hydroloeic Balance: <br />• Pond B contained a small amount of water will below the primary outlet. <br />• Pond C remains dry al this time. <br />• The East yard pond is dry at this lime. <br />• The Mine pond was almost dry al the time of this inspection. <br />• The Sedimentation pond at substation three contains about one inch of water at the western end. <br />• The Sedimentation pond at the Upper Hubbard Creek s'it remains dry. <br />• The ditches leading to the main portal are still filled with dirt and need to be cleaned and made functional as soon as <br />allowed by MSHA. All other ditches are functional at this time, but some normal spring maintenance will be needed to <br />clean out rocks and minor soil sliding. <br />• The two culverts on the east side of Upper Hubbard Creek site are functional at this time, but need to he cleaned by the <br />next inspection. <br />• The clean water diversion, above the west waste pile, needs to be diverted away from the waste pile and into the <br />cemetery road ditch before waste is placed in the area. <br />Processing Waste: <br />Please make sure that the new waste being added to the old waste pile is spread and compacted, and that the diversion ditch <br />is maintained. <br />Reveeetation: <br />The revegetation of Lower Hubbard Creek site and the Bear Creek site are progressing as expected, and are looking very <br />good at this time. <br />Slides and Damage: <br />The work on the potential slide area along the Cemetery road (in accordance with TR 29) is in progress al this time. <br />Others: <br />Please be aware that the thistles are now in the rosette stage at this time, and control should be performed before bolting has occurred <br />
