III. COMMENTS -COMPLIANCE <br />Below are comments on the inspectron. The comments rnclude discussion of observations made <br />during the rnspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of <br />Reclamation, Mining, and Safety (Division), Oblique aerial photographs were taken and <br />reviewed in the office by Kent Gorham of the Division on January 19. 2007. Deserado is an <br />active underground mine that produced in excess of 1.6 million tons of coal m 2006. Fresh <br />snow blanketed all areas. <br />Roads and ponds are snow- <br />covered. although roads had <br />been bladed of recent snowfall, <br />It does not appear that <br />temperatures are sufficiently <br />high to cause snowmelt as no <br />runoff or evidence of runoff was <br />observed, The facility area <br />appeared active and orderly. A <br />tram was berng loaded at the <br />coal loadout on this day. <br />The refuse area consists of a <br />number of separate refuse <br />piles. All refuse piles and <br />sediment ponds were snow- <br />covered No evidence of <br />slumps, slides, or damage was <br />noted in any of the photographs <br />taken <br />Nothing warranting immediate <br />on-the-ground inspection was <br />noted. <br />
