III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete quarterly inspection of the mine site and office records, conducted by Dan Mathews <br />of the DMG Grand Junction Field Office. Field inspection was conducted on May 31 and the morning of <br />June 2; office records were checked on the afternoon of June 2. Tonya Hammond, SCC owner <br />representative, was present during the inspection on June 2, but not on May 31. The offices of J.E. <br />Stover & Associates have recently been moved to a location at 7'" and Wellington, in Grand Junction. <br />The address is 2352 N. 7'", Unit A. Ms. Hammond's office, the official repository of public records "at or <br />near the mine site", is now at this location. <br />Weather was clear and dry during the field inspection, surface soils were moist on 5/31 due to light <br />showers the previous day. One document was received during the inspection; a copy of a cover letter <br />dated June 3, 2005. The letter indicates that the April 2005 CDPS discharge reports were submitted to <br />the WQCD and the DMG Denver Office. <br />Availability of Records <br />In general, required records were on file and up-to-date through the 1g' Qtr., 2005. One record related <br />concern was noted in the Division's March inspection report and is reiterated here. The current <br />Temporary Cessation Notice and related permit text on Page 14-1 contain out-dated references. The <br />Notice and text need to be updated to reflect the current status of the UTL and associated facilities. The <br />Notice will need to address, in specific, requirements of Rule 4.30.1(2)(d). The operator has indicated <br />that these changes will be provided within an upcoming permit revision application submittal. <br />A previously requested P.E. Certification for an artificial structural control in a permanent stream channel <br />(the engineered riprap "transition zone" at the former H.R. 2 crossing of Coal Creek) has been provided, <br />and was on file. <br />Roads <br />The condition of permitted roads was in general satisfactory, relatively little change since the March <br />complete inspection. The lower-most berm/water bar on the light use road up-gradient from the RSRDA <br />soil borrow area needs to be built up. Also, routine maintenance (grading and water bar repairs) will be <br />performed in conjunction with remedial reclamation work at the 2-West Portals site this fall. <br />Hydrologic Balance <br />Drainage and sediment control structures including diversion and collection ditches, culverts, berms, and <br />SAE silt fences were properly maintained and functional. Winter/spring precipitation was above normal <br />this year, but there have been no high intensity storm events that generated significant runoff in the mine <br />affected watersheds. <br />The condition of permanent ephemeral stream channels on the reclaimed areas appeared unchanged from <br />the condition described in the previous inspection, with the exception that the pool in the low area of the <br />North Decline channel had dried up. The relative depth of the Coal Creek channel bottom in the scoured <br />section adjacent to the Pond 10 embankment was measured. At its deepest point, it was 5.5 feet lower <br />than the end of the primary discharge pipe outlet. <br />3 <br />
