<br />IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement and date of abatement for the <br />violation, previous violations still requiring abatement and the termination of violations cited during previous inspections. <br />There aze no unabated violations on this permit prior to the inspection. <br />The spillage of mine development materials at the collector ditch to the 6-North Mains Ventilation Shaft <br />sedimentation pond is in noncompliance with the following rules for reasons stated: <br />Rule 4.05.3(1)(e). The spillage was not in compliance with the operational requirements. <br />Rule 4.05.5(2)(c). The spillage is not in compliance with this rule (sediment was not retained within approved <br />disturbed azeas). <br />Rule 4.05.18(1). The accumulation (deposition) of mine development waste (a disturbance) in the stream <br />buffer zone, from the spillage at the 6-North Mains sediment collection ditch, is not in compliance with this <br />rule. The Division had not specifically authorized this operation, and had made no associated findings. <br />As a result of these infractions, Notice of Violation number NOV CV-2006-004 was issued. Abatement <br />consists of cleaning the collector ditch (reported as accomplished on 24 August 2006 by the operator, to be <br />inspected by the Division by September 15, 2006). There was a small amount of mine development materials <br />deposited in the stream buffer zone. Vegetation was not totally covered, and vegetation appeazs through the <br />thin layer of deposited materials. The Division believes that the vegetation will recover, and that there would <br />be more disturbance in the stream buffer zone from attempts to remove the material than to leave it as it is. <br />There is sufficient vegetation between the deposited materials and the stream channel to filter any eroded <br />deposited materials, thus there is neazly no potential for impact to the receiving stream. <br />NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS <br />C-1982-056.
