IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required <br />abatement and date of abatement for the violation, previous violations still requiring <br />abatement and the termination of violations cited during previous inspections. <br />NOV CV-2002-009 was issued on June 17, 2002 for failure to conduct surface <br />blasting operations in accordance with the Rules and Regulations and in accordance <br />with the DMG permit. The NOV was terminated effective July 9, 2002. An assessment <br />conference was held on August 23, 2002 at the Division office. The operator has <br />agreed to the reduction of the civil penalty to 51,150.00. Payment of the penalty <br />is pending at this time. <br />Nothing warranting on-the-ground inspection was observed in any of the <br />photographs.
