Cattany <br />~~/ Division Director <br />RE: McNulty Cinder Pit, Permit No. M-1980-003, Unresolved Problems Noted in Pas~NtWt'~~f~L'~f'oTfl'~t~ <br />Reports L~ /D-R4-v2 ~.csP• r~d~~ ~ <br />Dear Mr. and Ms. McNulty: <br />It has come to the attention of the Division of Minerals and Geology that some problems noted in <br />past mine site inspection reports either have not been corrected, or have been corrected, but <br />documentation of the corrective actions taken were not submitted to our office. <br />Please see the enclosed inspection report for your mine site, issued as a result of a past inspection <br />of this site. Problems noted in this report, that our records indicate remain unresolved, have been <br />highlighted. DMG did receive your recent map submittal, but it was not drafted to include all the <br />items noted in the inspection report, nor was it in compliance with the specifications of the rules <br />cited in the report. Additionally, the revised map, and weed control plan must be submitted as a <br />technical revision to this permit, with the required S 188.00 application fee. Upon approval of the <br />revision, and submittal of photographic documentation that the permit boundary markers and mine <br />identification sign have been installed, and that the 55 gallon drum and buckets of hazardous <br />material have been removed from site or stored in adequate spill containment facilities, the <br />McNulty Cinder Pit will be considered to be in compliance. <br />If these issues are not addressed adequately. DMG will have no choice but to pursue enforcement <br />actions for non-compliance with State Statutes, Rules and Regulations, and/or conditions specified <br />in your permit.
