i <br /> <br />• <br />now, since the active operation has approached so closely to <br />the gas line, constitutes a deficency in the approved permit <br />application that I feel must be rectified. <br />I suggested a procedure by means of which the problem might be <br />most easily addressed. Simply put together a letter to the <br />owner of the gas line which specifies your agreement to <br />maintain a distance of 50 feet (or whatever distance is <br />adequate) from the line with your mining activities and to <br />compensate the owner of the gas line for any mining related <br />damage to it. Sign the letter, send it to the gas company, <br />request a signature from a representative of the gas line and <br />return the signed agreement to the Division. Presumably, the <br />owner of the gas line will sign such an agreement if the <br />specified distance and your commitment to compensate is <br />acceptable. Evidence of such an agreement will satisfy the <br />compliance problem indicated.
