III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaidenbach of the Colorado Division of <br />Minerals and Geology. John Weinman represented the operator. <br />The ground was wet. Vegetation has begun greening up. Both entrance gates were locked <br />RECORDS AVAILABILITY <br />All required records were available. The checklist ~s attached. <br />SIGNS AND MARKERS <br />All required signs and markers were properly displayed, including: mine entrance i.d. <br />signs, perimeter boundary markers, and stream buffer signs. <br />HYDROLOGIC BALANCE <br />Sedimentation Ponds - HG-8 was discharging an estimated 100 9pm; pond 003 was discharging <br />a trickle. Both discharges were clear water. Inslopes and embankments of both ponds <br />appeared stable. <br />REVEGETATION <br />Shrubs are beginning to leaf out on the four shrub parcels: E, HG-8 South, HG-8 North, <br />and 003. The shrubs appear significantly more mature on Parcel E than on the other three <br />parcels. <br />SLIDES AND DAMAGE <br />This was the first time the slump area was accessible since last October. A new one-inch <br />tension crack in the soil extends approximately 30 feet across the top of the slump at <br />piezometer PZ-2 (the piezometer that is second from the top of the slump). No other <br />evidence of ground instability was found. The stakes remain in alignment and no <br />additional bulge was apparent in the toe of the slump. <br />RECLAMATION SUCCESS <br />The ground water monitoring wells that were plugged and sealed in October 1998 were <br />checked for surface disturbance. Only very minimal disturbance was found at all six <br />locations (LC-1/UC-1. LC-2/UC-2, UC-3, LC-4, HG-1, and HG-2). The minimal disturbance <br />would support a decision to approve the Phase II/Phase III bond release application that <br />is now in review. <br />Page 3 <br />
