III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by DMG staff from the Durango <br />Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. The permit <br />was revoked over 5 years ago, Financial warranty was forfeited and utilized for final <br />reclamation. <br />All stockpiled earthen material has been removed and area re-graded. Coal Gulch has been <br />realigned to direct drainage to the culvert under Hwy 160. Re-graded areas appeared stable. <br />Sediment pond was dry. Primary spillway outlet was not located, assumed buried by recent <br />grading activities. Open channel secondary spillway was partially obstructed by recent grading <br />activities. Rock lining for outlet of secondary spillway had been removed. Portions of the <br />embankment outslope have been steepened to 1H:1V. <br />Vegetative cover was well established but stressed by drought conditions. <br />
