/ ' • • <br />INSPECTION REPORT - PAGE 2 <br />FILE N0. 74-41 <br />DATE: May 16, 1985 <br />OBSERVATIONS OF IMPORTANCE: <br />1. The operator is to have a dry mining and screening operation as per the <br />Mining Plan & Exhibit G. Currently, water is being drawn from Plum Creek to <br />wash gravel, wash water is being settled in a pond adjacent to Plum Creek. <br />2. Topsoil (overburden) has been stockpiled above the pit wall in 3 <br />locations. One stockpile is currently eroding into the pit. <br />3. The operator was to maintain a minimum setback of 150 feet from Plum Creek <br />on the southeast corner to as much as 700 feet from Plum Creek as portrayed on <br />Exhibit E - Reclamation Plan Map. The operator's settling ponds, H2O intake <br />and stockpiles are within the area that was to remain unaffected. <br />4. The operator is descharging muddy, unsettled water from the settling pond <br />directly into Plum Creek via a pipe. Mr. Brinkmann immediately shut down the <br />wash plant when this was brought to his attention. <br />5. The highest quality topsoil is being hauled out of the pit. Trucks were <br />removing the material on the date of the inspection. The permit calls for the <br />replacement of 6-12 inches. Mr. Lawrence indicated that topsoil is also being <br />brought in. <br />6. The operator is in compliance with the permit on the southeast corner, <br />however the disturbance follows Plum Creek with @100 foot setback N from the <br />SE corner. This deviates from the required undisturbed setback. <br />7. The operator is not following the approved phasing and timetable for <br />mining as outlined on the mining plan map. <br />8. The violation of permit No. 74-41 will be considered for Notice of <br />Violation and Cease and Desist at the May 22-23, 1985 meeting of the Mined <br />Land Reclamation Board. <br />PEOPLE PRESENT <br />Mr. Earl R.
