III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology (DMG). The weather was warm and ground conditions were generally dry with <br />some muddy areas due to recent episodes weeks of rain and snow. Areas were accessible <br />by foot and vehicle. Bobby Steele represented Lorencito Coal Company (LCC) during the <br />inspection. <br />Signs and Markers <br />Two permit boundary markers were noted lying on the ground on the east side of the road <br />about 100 feet after crossing the bridge over the Purgatoire River. These signs should be re- <br />established in their proper locations. The mine identification sign was found in compliance <br />with Rule 4.02. <br />Roads <br />Mr. Steele has been working on the permanent road where it crosses the disturbed area. <br />One low spot in the road was noted between the 3'd and 4th culvert after entering the <br />disturbed area from the east. A relief drain and ditch directing flow to the west will be <br />constructed to promote surface drainage for this section of road. <br />The light use road to pond 8 has a significant amount of rockfall from the cut slope littering <br />the road. This rock should be cleared and used for a downdrain to route drainage into the <br />canyon bottom from the road. The road should also be graded down to the pond to allow <br />vehicle access. <br />Hydrologic Balance <br />High water marks on the banks of Lorencito Creek indicate the creek was significantly higher <br />during the last week or so due to snowmelt and runoff. Disturbed area containment ditches <br />were traversed and found in good condition with a minimal amount of sedimentation given <br />the significant precipitation. LCC should install extra straw bales at the topsoil pile SAE on <br />the east side of the disturbed area. Some ditch cleanout on ditch D75 between Fill 7 and Fill <br />9 is also necessary. Wier boxes to measure flow at each pond outtall should also be <br />checked and leveled to ensure accurate flow readings in the event of discharge. The silt <br />fence east of the Lorencito haul road should also be replaced or re-positioned due to <br />sediment build-up. <br />All sediment ponds at the site held water but none had discharged as a result of recent wet <br />weather. All embankments and spillways appeared in good condition. <br />
