III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />The two main Elk Creek culverts were operational although the flow in EIk Creek was not very large. The <br />topsoil stockpile on the upper portion of the facilities had a good vegetative cover. The upland diversion ditch <br />had capacity and the topsoil sign was up. There were no problems with any of the facilities at the Elk Creek <br />portal area. There were no leaks at the fuel facility. The operator has made efforts to stabilize the small <br />slide behind the rock dust bin. There was a trickle of water coming out of the pipe that drains the base of the <br />slide. <br />Hubbard Creek Sites <br />At the lower Hubbard Creek site, the backfill was stable with a moderate vegetative cover. The entrance road <br />was in good condition and the mine [D sign and surface disturbance markers were up. <br />There were no problems at the upper Hubbard Creek site. The sediment pond was dry and the pipe spillways <br />were clear. There was moderate vegetative cover. The mine [D sign and the surface disturbance markers were in <br />place. <br />At the Hubbard Creek fan site, the entrance gate was locked and the mine ID sign was up. The access road was <br />in good condition. There was a little water in Pond F. The pipe spillways were operational. The upland diversion <br />ditch, culvert and downdrain on the south side of the property were functional.
