(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1982-112 <br />INSPECTION DATE 09/04/2007 <br />INSPECTOR'S INITIALS DEZ <br />This pre-operational inspection of Permit Number M-1982-112 (Miller Gravel Pit), conducted by Deb E. Zack of the DRMS, was <br />prompted by a request from the operator for approval of an amendment to the current permit to add 69.2 acres, bringing the <br />total permit acreage to 130.2 acres. No representative for Rick Hunt was present during this inspection. However, Eric <br />Whiteman of Schmidt Construction made himself available for any questions this inspector had. The pit is located <br />approximately 10 miles north of Elizabeth, CO and currently consists of approximately 61 permitted acres where approximately <br />20 acres are currently active. <br />The mine entrance identification sign and permit boundaries were clearly marked. Portions at the northern end of this site that <br />have been reclaimed have well-established vegetation. The grading, topsoil replacement, and seeding across portions of this <br />site appear to have been done properly, and have resulted in substantial vegetative cover (alfalfa) as required by the approved <br />permit's reclamation plan. <br />According to the technical revision approved by the Division (June 4, 1997) the maximum acreage to be disturbed atone time <br />is 20 acres. The current active operation is abiding by this revision. <br />The only matter of concern is that the secondary containment area for the pump area near the wash/settling pond at the <br />northwestern portion of the active pit area is inadequate (see photo 4). It appeared that fuel and/or lubricants were being stored <br />at the time of this inspection (see Problem No.1 on pg. 3). All storage tanks, petroleum and hazardous materials on site for any <br />period of time shall have secondary containment. The Operator must supply photo documentation that the fuel tank and any <br />containers to remain on site are stored in a proper secondary containment structure or are removed from the site on or before <br />November 30, 2007. If the containers are to remain on site, then a berm must be constructed around the tank and any other <br />containers. The dimensions of this berm must contain all contents of the tank (when full) plus 10% of the tank's capacity. In <br />addition, a liner shall cover the entire basin as a barrier to infiltration. <br />Otherwise all activities and completed work at the time of inspection appeared to follow the guidelines and regulations set forth <br />by the state and the mining and reclamation plans for the pit, and no additional problems are noted for this site. The site is <br />stable, and there appears to be no offsite erosion or activity, and no long-term (greater than 72 hours) water retention (other <br />than in the wash/settling pond -which is covered by an OSE approved augmentation plan -case no. 92CW 106) was <br />observed. <br />Responses to this inspection report should be directed to Deb E.
