III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the <br />operator during the field inspection. Bill Bear represented the operator for the records check. <br />Facilities <br />The operator is clearing out the mine office interior. Apparently, the floor tiles have asbestos in them so the <br />operator is working with an agency to discard the tiles properly. <br />Reclamation <br />The reclaimed access road leading to the eastside fan and westside portal areas was stable and well vegetated. <br />The reclaimed fan portal area was stable and well vegetated also. The cracks and depressions at the backfilled <br />and graded west side portals are slowly being covered in with dirt from the hill slope directly above it. No new <br />cracks or depressions have appeared recently. There was a faint odor of smoldering coal near the backfilled west <br />portal area. <br />Noxious Weeds <br />Tamarisk continues to grow along the water's edge at the hillside spring treatment pond and at the east hillside <br />spring. Clumps of thistle are growing along the hill slope below the reclaimed portal access road. Some thistle is <br />also growing near the reclaimed fan portal area and the reclaimed west side portal area. Spraying is needed. <br />Hydroloev <br />There was very little water in the sediment pond. The pond spillways were functional and the embankment was <br />stable. The primary discharge pipe gate was closed. The hillside spring water treatment pond was discharging <br />the usual orange-colored water at a rate of about 20 gpm. The discharge has been found to be in compliance. <br />The collection ditches and culverts were functioning properly. The riverside berm was functional as well. There <br />were no problems with the two alluvial wells. Well caps were on. The east side hillside spring was flowing into <br />its channel which brings it into the treatment pond. The temperature ofthe spring water was measured at 101 <br />degrees Fahrenheit at a point about 10 feet below the origin point. <br />Roads <br />The paved entrance road was in good condition. The bridge was passable. <br />Sins and Markers <br />The mine ID sign post was still on the ground. Surface disturbance markers were up. <br />Records <br />The records were in compliance, as shown on the attached records checklist <br />c: /word/bear3/insp0707 <br />
