Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules and <br />Regulations, and the permit also are identified below. <br />1. Coal fines and sediment have deposited in the west collection ditch that <br />enters the sedimentation pond. The sediment must be removed to establish the <br />proper dimensions of the channel to prevent overtopping. The material removed <br />must not be pushed or shoveled onto the adjacent hillslope. Instead, it must <br />be disposed of in the pond or underground. <br />2. One small seep was noted on the hill cut 15 feet east of the breaker, 10 <br />feet up the slope. Estimated flow was 1/8 gpm. No signs of instability were <br />noted. <br />3. Despite the runoff from snowmelt, drainage and sediment control <br />structures were functioning properly. The pond had one or two feet of water <br />in it but was not discharging. <br />
