These will all be eloped to 3:1 or less; compliance will. be verified by a
future site inspection.
There are 2 topsoil stockpiles remaining in the area south of Coal Creek. One is near the
center of the disturbed area and contains approximately 3600 cubic yards, the other ie et the
southwest corner of the disturbed area and contains approximately 16,600 cubic yards. Also,
topsoil from the south margin stockpiles mentioned in previous inspection reports hne been
spread over several acres near the south end of the pit. According to the soils and permit
maps, and on the ground observations, it would appear that the Nederland Very Cobbly Sandy
Loam topsoil should have been salvaged and preserved by the operator from approximately 43
acres at the site. Assuming an average A-horizon depth for this soil of 4.!i inches (the soil
survey gives a range of 3 to 6 inches), there would have been approximately 26,000 cubic
yards of A-horizon soil available for salvage. Given the amount of soil av:~ilable in the two
remaining stockpiles, and the amount of soil that has already been e~~read, it is the
Division's view that the operator adequately salvaged soil for reclamation, and that
replacement of lees than the 6 to 10 inches of soil specified in the permit ie werrented in
this case since the operator cannot be required to replace more topsoil than was originally
present at the site.
There is an area located south of the creek and east of the culverts where clay extraction
took place. Thies area needs to be graded for positive drainage and dreasecl with 6 inches of
the stockpiled soil.
An area near the center of the disturbance south of the creek was formerly used for gravel
processing, and is now covered with a thin layer of clean, crushed rock. 7'hie area needs to
be scraped clean to prepare an adequate seed bed.
Based on more detailed observations at the south margin of the pit, and on subsequent review
of permit documents and maps, it is clear that the operator has disturbed lz~nd outside of the
permitted area. This off-site damage ie in an area referred to ae the "South Borrow Area".
The permit documents indicate that Varra Companies has legal right to entec~the South Borrow
Area, and further indicate that the South Borrow Area is included in the ~~ounty Permit for
the Jenkins Site, however this area was excluded from the reclamation permit at the time of
the 1986 amendment. The Division requires a map delineating the size ol: the unpermitted
disturbance (see PV /1 on the final page of this report).
cc: Carl Mount, DMG
James S.
