III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II Mine conducted on Apri122, 2004 by Mike Boulay <br />and Jim Stark of the DMG. Roy Karo of Seneca Coal Company (SCC) was present during the <br />inspection. Weather conditions were cold and overcast. It began snowing part way through the <br />inspection. The mine site was partially snow covered. Other than the use of the shop and truck <br />wash facilities, there was no activity at the mine site. <br />Roads <br />Road surfaces site wide were wet and muddy. Access to the site was limited to the two bone <br />yazd azeas, the shop/facilities azea, and the permanent road accessing the Upper Wolf Creek area. <br />Although the permanent road became partially snow packed and very slick, the site was <br />accessible to the top of the former Wolf Creek Pit. The Upper Wolf Creek azea appeazed stable <br />with green grass emerging through the snow cover. All other mine site roads were impassable <br />due to very muddy conditions. <br />As noted in the previous inspection report (dated 03/30/04) a significant gully has formed <br />immediately north of the culvert crossing where Post Mine Channel PM-6 flows beneath the <br />Permanent Road above Post Mine Channel PM-1. To ensure compliance, please repair the gully <br />or construct an adequately armored road drainage nmout at this location. Also noted during the <br />previous inspection, Culvert 53A located beneath the access road to the New Boneyazd needs to <br />be cleaned out and maintained. SCC was in the process of removing sediment from this culvert. <br />The ditch and culvert will require additional cleaning and maintenance on the outlet side. Please <br />continue to maintain ditches, culverts, and road drainage site wide. <br />Hvdrolo¢ic Balance <br />Ponds 002, 003, and the Truck Wash Ponds were the only ponds accessible at the site. Ponds <br />002 and 003 were both full and dischazging clear water. The Truck Wash Ponds were retaining <br />water but not discharging. No problems were noted at any of the pond locations. <br />Fish & Wildlife <br />A sharp-tailed grouse lek was viewed in the Wadge Pasture area. The lek was active at the time <br />of viewing. A total of eight sharp-tailed grouse were observed at the lek. Several of the grouse <br />were observed strutting. <br />
