III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II-W Mine conducted on July 10, 2001 by Mike <br />Boulay of the DMG. Chuck McCulloh of Seneca Coal Company was present during the <br />inspection. Weather conditions were sunny and warm. Ground conditions were dry throughout <br />the majority of the site. <br />Hydrologic Balance <br />SCC will begin work on reclaiming the Clean Water Diversion located south of Haul Road A. <br />Water from the undisturbed area above this ditch (Watershed SWS 4) will be routed to Culvert <br />AS and will ultimately be treated by Pond 006. This plan was approved with Technical Revision <br />35 as part of the Pond 006 Phase V design. Culvert H1 will be removed as it will no longer be <br />needed. <br />Topsoil <br />The eastern perimeter of the South Area pit at the location of NOV CV-2001-002 was inspected. <br />Mitigation measures completed to date include; removal of blasted material/flyrock from the site <br />of the NOV, burial and compaction of the larger rocks at the base of the slide area, regrading of <br />the disturbed area, and replacement of topsoil. The operator has successfully completed these <br />abatement steps. <br />The final steps necessary to abate the violation include reseeding of the entire slide azea, and <br />reseeding the temporary access road above Pond 015 to the base of the disturbed azea. Once the <br />final abatement steps have been successfully completed, the violation will be terminated. The <br />operator has requested an extension to seed these areas in the fall, which is consistent with the <br />recommended seeding window. Please complete the required seeding and mulching activities <br />during the normal planting season extending from August 15 to November 1. <br />As previously noted during the last inspection, a small slump and crack has formed at the top of <br />the ridgeline, immediately north of the slide area associated with NOV CV-2001-002. SCC will <br />begin work to repair the crack by removing topsoil from the area of the slump and regrading and <br />dressing the slope at the location of the crack. <br />Good progress has been made in the abatement of NOV CV-2001-012. A buffer zone has been <br />established between disturbed and undisturbed ground around the perimeter of the active mining <br />areas in the South Extension. A trackhoe was completing the work on establishing the buffer <br />zone at the time of this inspection. <br />
