III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of CDMG. The weather on <br />this day was seasonal and mild. This former underground mine is reclaimed. Some <br />buildings remain as permanent for use by the landowner. <br />Availabilitv of Records <br />The public copy of the mine records is kept at the Clerk and Recorders office at <br />the Las Animas County Courthouse. The liability insurance certificate shows an <br />expiration date of October 1. 2001. The latest rider to the bond documents was <br />not found. The latest Discharge Monitoring Reports (DMR's) were from the 4m <br />quarter 2000. Surface water records were found through May 2001 and ground water <br />records were found through June 2001. The latest copy of the quarterly inspection <br />for the sediment pond and the waste pile was dated March 2001. Before January 1, <br />2002, please ensure that these records are brought up-to-date. <br />Hydrologic Balance <br />The sediment pond appeared to be nearly dry. Standing water was not visible <br />around the edge of the cattails in the pond. The trash rack on the primary <br />spillway drop inlet was found in place and clear of vegetation or debris. Ditches <br />and culverts throughout the site were found in good condition. The refuse well <br />was capped and in good repair. <br />Processing Waste <br />The 100-year ditch above the refuse pile requires cleaning in two areas. The <br />first is a 200-foot section behind the shop building. Sloughage from above this <br />ditch should be removed and placed on the crest of the ditch bank to the outside <br />to ensure adequate capacity. The second area requiring maintenance is about 50 <br />feet from the west end of this ditch. Sedimentation and ditch bank grading will <br />ensure future function of this section. Straw bales and roof bolts above this <br />section of ditch should be maintained or removed. Contour furrows on the refuse <br />pile highwall slope are intact and have additional capacity. <br />Revegetation <br />The growing season is over. Vegetation is dry. The region is badly in need of <br />precipitation. <br />Overall, the site appeared in normal condition for the fall season. <br />3 <br />
