III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II Mine conducted on July 16, 2002 by Mike Boulay <br />of the DMG. Robert Shevling of Seneca Coal Company (SCC) was present during the <br />inspection. Weather conditions were warm and hazy. Haze was present due to wildfires burning <br />in the Steamboat Springs area. Ground conditions were dry throughout the mine site. <br />Hvdroloeic Balance <br />Site Sedimentation Ponds 002, 004, 008, and the Pecoco Pond were inspected. Sedimentation <br />Ponds 004 and 008 were full and dischazging cleaz water. Pond 002 was retaining water but not <br />discharging. <br />Road surfaces and road ditches were dry and well maintained. No problems were noted at any of <br />the remaining haul road and access road locations. <br />Backfill & Gradin <br />Work was in progress to backfill and grade a remaining area of disturbance in the vicinity of post <br />mine drainage channel PM-5. A dozer was working to regrade the steep slope above this <br />drainage channel at the time of the inspection. Only a small area on the extreme eastern end of <br />the Wadge East Pit area and one topsoil pile location (Topsoil Stockpile X) north of Road BI <br />remains to be final graded. Seeding should be completed at these locations in September or <br />October in accordance with contemporaneous reclamation practices. <br />Reve etation <br />Vegetation monitoring was observed at two locations on the mine site during this inspection. <br />ESCO was conducting point intercept, clipping production, and counting shrubs for vegetation <br />monitoring purposes in the upper Wolf Creek Area Pit and at the Pecoco Pond. <br />
