<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the Terror Loadout was performed by <br />Christine Johnston of the Division. Itelly Fritzler of Terror Creek <br />Company was not available during the inspection, but I talked with <br />him over the phone on Friday, April 29, 1994. The weather during <br />the inspection was cloudy and cool. <br />SIGNS AND MARKERS <br />A permit boundary sign has been knocked over in the vicinity of the <br />east gate to the permit area. The sign should be replaced. <br />HYDROLOGIC BALANCE <br />Maintenance has been performed on culverts and ditches throughout <br />the site. CMP #1 requires some additional work at the inlet. Dirt <br />and rocks have been pushed into the inlet of this culvert. The <br />specified design for this culvert has not been jeopardized. CMP #3 <br />requires some additional work at the inlet. Ditch B, on the west <br />side of CMP #3, requires regrading. This area is still quite wet, <br />so maintenance should be performed when conditions allow. <br />SUPPORT FACILITIES <br />TCC is planning to dispose of sediment clean-out material to <br />Mountain Coal Company's permitted refuse pile. TCC should submit <br />a minor revision for this activity. Rock has been placed in the <br />bottom and on the side slopes of the fuel containment berm. The <br />fire disposal area has been cleaned up and batteries previously <br />stored on pallets have been removed and placed in a 55-gallon <br />barrel. The coal fines pile has been moved away from the earthen <br />berm of the coal pad. Trees removed from the surrounding orchard <br />were burned recently. It appears that the burning was contained <br />and located away from the coal pad. <br />TOPSOIL <br />Seeding of the topsoil pile and cut and fill slopes of the expanded <br />truck parking area has not been completed due to wet conditions. <br />The topsoil still needs to be moved away from the light-use road. <br />This also has not been done dtie to weather, but will be done as <br />soon as conditions improve. Topsoil signs will also be placed when <br />this work is completed. The area where this topsoil pile is <br />located is rarely used for the Loadout operations; however, TCC <br />should post the topsoil signs while awaiting work on the pile to <br />
