III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe <br />any enforcement actions taken during the inspection and the fads of evidence supporting the enforcement action. <br />This was a phase II and partial phase III bond release inspection conducted by Janet Binns of the Division <br />of Mineral and Geology. Mr. Rick Mills of CYCC, represented the permitee, Mr. Henry Austin represented <br />the Office of Surface Mining and Enforcement, and Mr. Rob Emst represented the Bureau of Land <br />Management. Eckman Park and Mine 1 are surface mines that have been reclaimed. <br />Roads: Access roads have been approved to remain permanently. Roads remain in good repair though out <br />the mine site. Roadside ditches aze in good repair. No problems noted with the roads. <br />Hydroloeic Balance: Pond H contained water and was discharging at an extremely low rate making it <br />impracticable to collect a water sample of the effluent. Discharge rate was a trickle and was not measurable <br />as a rate. Dischazge water was clear. The discharge point from Pond H corresponds to NPDES permit No. <br />CO-0027154, dischazge number: 009A. CYCC monitors this dischazge point for water quality and <br />forwards this information to DMG. There have been no exceedences of water quality standards from Pond <br />H for the last eighteen months. Repairs conducted to the discharge weir are holding well. Contour ditches <br />at the Mine 1 area have been approved to remain as permanent features to direct additional runoff to Pond <br />H. Pond H is approved to remain as a permanent stock water pond. <br />Pond A was holding water and discharging too low on the staff gauge to accurately measure. Field <br />pazameters of the Pond A discharge were taken with the following results: pH= 8.3 EC= 3190 µs <br />Temp. =82° f, time = 14:45. Water quality samples were collected at this time for full-suite analyses. <br />Water samples were stored in a cooler with ice in a locked vehicle. Samples were delivered to an <br />independent laboratory on July 21, 2000 @ 7:55 a.m. Results of the effluent analyses will be forwazded to <br />CYCC as it becomes available. Discharge was clear with no visual problems noted. The embankment and <br />inlets to the pond looked fine. Pond A embankment is well vegetated. There has been two water quality <br />standard excursions from Pond A in the last eighteen months. The the excursions entailed failure in the <br />WET test of P. promelas. One excursion occurred during the first quarter 1999, with 5 subsequent tests <br />passing. The second excursion occurred in during 2"d quarter 2000. CYCC did not initiate accelerated <br />WET testing due to instruction from CDPH&E received by CYCC dated 4/13/98. <br />CYCC has numerous stockwater ponds located through out the reclaimed mine. Permanent stockponds <br />were certified in 1993. Certification "as-builts" may be found in three binders at the Division office in <br />Denver and at the mine office. Several stockponds required additional repair to bring them into compliance <br />with the designs. These repairs were conducted in 1996. DMG's inspection report, dated September 23, <br />1997, confirms that stockponds spillways were repaired appropriately. Livestock ponds continue to be in <br />satisfactory condition. <br />Permanent drainages were inspected. PG 41-1 rip-rap and rock check dams are holding up well. A high <br />intensity rain storm occurred 3 days prior to the inspection. The drainage structures showed sign of <br />considerable runoff flow having recently occurred but the structures were intact and functioning well. <br />stockponds 41-g and 41-h were both holding water. The rip-rapped drainage north of PG 41-h was in good <br />condition. Vegetation has taken hold within the rip-rap. PG 31-1A has had check dams placed in downcut <br />areas. CYCC used railroad ties installed perpendicular to the drainage, anchored into the slopes on either <br />side of the drainage. Dams were 2-3 ties high depending on the depth of the drainage at the point of <br />installation. These check dams appear to be functioning well. There was no evidence of undercutting or <br />sidecutting of these check dams. stockponds 31-f and 31-h both contained water.
