~. <br />• <br />III. COMMENTS -COMPLIANCE <br />Below are comments an the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by Wally Erickson from <br />the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (970) 247-5469. The permit for the Coal Gulch Mine was revoked over <br />5 years ago. Financial warranty was forfeited and utilized for final reclamation. <br />Ty B. Hawkins, Fire Hawk Contractors, 26072 Hwy 160, Box 5310, Durango, CO <br />81301, phone (970) 259-6440, was present during the inspection. Mr. Hawkins is the <br />landowner for portions of the permit area. Mr. Hawkins had several questions <br />regarding landowner liability for development of reclaimed lands. Mr. Hawkins <br />concerns have been forwarded to the DMG Denver Office, Harry Ranney, lead <br />specialist for the Coal Gulch Mine. <br />Mine identification sign has been replaced by sign for Fire Hawk Contractors. Entrance <br />gate was open. Backhoe was loading truck from stockpiled material. Fire Hawk <br />equipment and stockpiles of imported rock, soil, and vegetative debris and industrial <br />debris were located on site. Extent of redisturbance created by Fire Hawk has <br />increased with stockpiled industrial debris. <br />Sediment pond was holding water approximately 1.5' depth, no discharge noted. <br />Embankment appeared stable. Backfilled and graded areas, not recently redisturbed by <br />Fire Hawk activities, appeared well vegetated and stable. <br />
