Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules and <br />Regulations, and the permit also are identified below. <br />Mine records were checked prior to the inspection. Hydrologic <br />monitoring records were available from Mr. Reschke's field book. <br />However, the operator was advised to have the final monitoring reports <br />on file at all times. The only record that could not be found was the <br />Federal Permit. The Division has a copy of the permit. The operator <br />was advised to get a copy from the Denver office and keep it on file at <br />all times. Records will be rechecked next inspection. <br />2. Road maintenance was evident, fallen rock is usual this time of year but <br />the operator has been clearing the access road at frequent intervals. <br />3. A complete inspection of the drainage and sediment control system was <br />conducted. The system was functioning properly, no concerns were <br />identified. <br />4. The operator needs to finish maintenance work on the diversion behind <br />the coal stockpile and remove the .debris on the adjacent coal <br />stockpile. Most of this work will need to be completed by hand. <br />5. A landslide had occurred, affecting the front 25' of the portal bench. <br />The slide is a reoccurrence of previous years. The operator was <br />instructed to remove stockpiled coal from the affected area. <br />
