III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />dun ng the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground site is entirely reclaimed. Ground <br />conditions on this day were dry and the weather was very hot. Mr. A.J. Iuppa, the <br />landowner at the site, opened the gate allowing access to the area. Ron Thompson of <br />Peak Project Management was also present for the inspection. Mr. Thompson conducts the <br />quarterly refuse pile inspections for the operator. <br />Revegetation <br />The interseeded area of the refuse pile was traversed on foot. It continues to be <br />poorly vegetated. Most contour furrows are full of sediment and many are breached. <br />Erosion on the slope continues to be a problem. A large gully is forming immediately <br />adjacent to the southern side of the lower portion of the riprap ditch. It appears <br />that a significant storm event caused most of the erosion as evidenced y a high water <br />mark in the lower sections of the ditch. Vegetation on the topsoil pile footprint area <br />appeared very good and has not been grazed this season. Cattle were not observed on <br />the reclaimed area during the inspection. <br />Overall, the site appeared in average condition for early fall. The site could use <br />moisture, especially a good snow cover. <br />Page 3 <br />
