ORIGINAL -PUBLIC FILE <br />Page 2) <br />MINE ID # OR PROSPECTING ID #: nn-t est~-I ~s; <br />INSPECTION DATE: 8/I SIn6 INSPECTOROS INITIALS: -S~ <br />OBSERVATION <br />The Division conducted a monitoring inspection of the site as part of sites <br />to be inspected during the fiscal years 2006 and 2007. The site is a 44 <br />acre lime stone mining operation located approximately 10 miles north east <br />of Las Animas Colorado, in Bent County. Present during the inspection was <br />Mr. Manny Torres, of Fort Lyon, Colorado. <br />The site was permitted after the operator was brought before the MLRD BORAD <br />FOR mining with out a permit. Site was not active at the time of the <br />inspection, but evidence of fresh mining activity was noted at the time of <br />the inspection. Mining consists of excavators digging to a depth of <br />approximately 2 to 3 feet of the lime stone and haul trucks removing the <br />mined lime stone. The lime stone is utilized to shore up the embankments of <br />the Fort Lyon Canal. <br />Approximately 7 acres appeared to have been disturbed during this <br />operation. Stockpiles of limestone ready to be hauled away were noted in <br />the main pit floor. Observed the canal embankments where the lime stone is <br />being utilized. The financial warranty was calculated when the permit was <br />issued in 2002 and the amount of disturbance did not increase since the <br />warranty was calculated at $24,700.00 for a maximum disturbance of 10 <br />acres. However, if the current maximum allowed affected area increase, the <br />operator must submit a TR TO the Division and post the appropriate warranty <br />increase, prior to mining outside of the allowed affected areas of 10 <br />acres. <br />Permit sign even though not posted at the time of <br />be sited as a problem because, of the difficulty <br />vandalism.
