<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On March 31 an April 1, 1994, a complete inspection was conducted at the O.C. <br />mine no. 2. Mr. Weaver was contacted March 31 concerning the records. The <br />inspection was conducted April 1, 1994. <br />Records were checked and were in order. Mr. Weaver had obtained an <br />NPDES conversion of the industrial waste water permit to a general permit. <br />The weather at the time of the inspection was clear and warm. The south facing <br />slope of the mine was mostly clear of snow. The ditch just up from the pond <br />was still snow covered. The pond had snow in the bottom but no melt water. <br />The site looked much as it did last fall. The operator is required to remove an <br />additional $5,000 from the liability amount by June 1, 1994. The Board Order <br />reads as follows. <br />1. By June 21, 1994, the operator shall reduce the reclamation liability at the <br />O.C. Mine No. 2 to $36,000; or, <br />2. The required bond amount shall become fixed at $40,898, and the <br />operator shat( submit this amount to the Division by June 21, 1994. <br />
