<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by Wally <br />Erickson from the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, <br />Durango, CO 81301, phone 1970) 247-5469. Jim Hendricks was not located and <br />therefore not available to accompany the DMG inspector. <br />Signs & Markers -Mine identification sign was posted at the mine entrance. Public <br />access is controlled by gate and fence, gate was open. Permit boundary markers were <br />observed. Topsoil stockpile signs were posted. <br />Roads -Haul roads and access roads were well maintained. Haul road within permit <br />area is asphalt surfaced. County road, providing access to the mine entrance, was <br />recently asphalt surfaced. Road side drainage ditches and culverts appeared clear and <br />functional. <br />Backfill & Grading of the rock fill area was complete, topsoil replacement had <br />commenced. <br />Hydrologic Balance - Sediment pond 2, located along the west side of the permit area <br />was dry. Rock check dams located in steep section of pond inlet ditch were intact and <br />stable. <br />Support Facilities -Mutual Use Area (MUA) contained numerous vehicles, heavy <br />equipment, material stockpiles, truck scale and fuel storage tanks. Fuel storage tanks <br />appeared intact, no evidence of rupture or leakage. Fuel tanks, 55-gallon drums, and <br />recycle asphalt stockpile were surrounded by spill containment berms. <br />
