III. COMMENTS - COMPLLAIVCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Reclamation, Mining and <br />Safety. Bill Bear represented the operator, Bowie Resources LLC. The operator is currently longwall mining in <br />the third panel ofthe west district. In late October, they will move to a new district. <br />Main Mine <br />The slide on the cut slope between the D-seam portal bench and the utility bench appeared to be relatively stable <br />for now. There was no evidence now of any ground water seep in this slide area. Some of the slide material was <br />used to build up the access road outside berm. Remedial work in addition to that performed by the operator will <br />be requested by the DRMS. There has been a persistent seep in the former slide area just to the west of this slide. <br />There was a small amount of stockpiled coal on the D-seam portal bench. The highwafl was stable. The highwafl <br />at the B-seam portal bench was also stable. No slope instability was noted at the excess material storage area <br />across the haul road from the B-seam portal bench. There was a small seep at the base of this storage azea. <br />The topsoil stockpile was well vegetated. The small slide in the cut slope behind the wash plant has stabilized. <br />The culverts and ditches in this area and at the entrance to the mine were clear. The main coal stockpile at the <br />bottom of the hill was somewhat small in size. There was no evidence of fugitive dust along the highway. Pond <br />B had a moderate amount of water in it. The float was attached to the primary but the pond was not discharging. <br />The main paved haul road was in very good condition. The access road up to the utility bench was in good <br />condition. Surface disturbance markers were up, as was the mine ID sign at the entrance. <br />Gob Piles <br />The gob pile haul road was in good condition. The road ditch and berm were functional. There was only a little <br />water in Pond C. The operator will be completing the pond cleanout soon. Pond D was dry and only a little <br />water was in Pond F. Surface disturbance markers were up. Additional ones will be put up near Pond F. <br />The top of gob pile no. 2 was fairly dry and had positive drainage. Refuse was graded out for additional drying, <br />followed by compaction. The pile outslopes were stable. The operator will be covering the pile outslope with <br />soil material soon. The cove~ll pile was stable as well. Pond F collection ditches were functional. <br />Unit Train Loadout <br />A train was being loaded during the inspection. The coal loading process was very clean, with no discernible <br />fugitive dust. The operator had worked on the upland diversion railroad culvert near the overhead conveyor. The <br />half culvert down drain feeding into Pond K also was repaired. <br />Pond J and Pond K were dry. Both of the embankments were stable. The outslopes of the railroad bench were <br />well vegetated. The silt fence at the toe of the outslopes could use repair but the operator is going to submit <br />hydrology designs to show that the silt fence is no longer needed for the small area exemption outslopes. <br />On the west end of the railroad loadout flacks, water was flowing through one of the railroad culverts from the <br />field upgradient of the tracks. Also, water was flowing out of one of the French drains. The bench was stable. <br />c:/word/bowie2/insp0906 <br />
