<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Mine, focusing on <br />revegetation success. The inspection was conducted by Dan Mathews <br />of the DMG Grand Junction office, 2148 Broadway ~C-5, Grand <br />Junction, CO 81503, phone (970) 242-5025. Weather at the time of <br />the inspection was partly cloudy, cool and windy. George Patterson <br />and Jim Mossman of Kerr Coal were present during a portion of the <br />inspection, and several maintenance items identified during the <br />previous inspection were viewed and discussed while they were <br />present. <br />Status of the maintenance items is as follows: <br />1. Maintenance of the silt fence on the Pit 1 area ridge has <br />not been performed. There are actually two silt fences in <br />sequence here, the first is an old felt silt fence which is no <br />longer functional, and the second a newer filter fabric fence <br />which appears sound. The small sump area in front of the <br />filter fabric silt fence has largely filled in with sediment. <br />The sediment needs to be excavated, or a new silt fence <br />installed immediately upslope. <br />2. Minor grading and dozer tracking was performed in the area <br />of the small slump on the east facing Pit 1 area slope. The <br />scarp appears to have been eliminated. <br />3. Stabilization of the erosion in the drainage between the <br />double culverts and Pond E had not been done. George <br />Patterson was on site to view the gullying and develop a <br />stabilization plan. The drainage segment of concern has <br />apparently been a problem in the past, and had been previously <br />lined with stream cobble, most of which was washed out this <br />spring. The operator indicated that they planned to riprap <br />the 150 foot segment which has scoured with angular riprap. I <br />suggested that they contact the DMG lead specialist to <br />determine whether a revision plan addressing riprap <br />specifications would need to be submitted. <br />4. Contour furrow repair on the slope above Pond A, as well as <br />various other locations on recently reclaimed slopes, has been <br />properly completed. <br />
