(Page 4) <br />MINE ID # OR PROSPECTING ID #: M-Anna-ma <br />INSPECTION DATE: _MdK9, ~nnfi INSPECTOR=S INITIALS: ras <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective actions) were identified during this <br />inspection. The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMSlPOSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE - <br />3~he operator had disposed of sediment and run heavy equipment on the adjacent landowner's 07 / 12 /06 <br />property (Tony Finleyy) The area of alleged excavation onto Mr. Fmley's proppeerty is unknown. An <br />area of approximately 0.1 acre was disturbed, in possible violation of Section 34-32.5-116 (4}(i) and <br />Rule 3.1.5(3) for failure to protect areas outside the affected lands from slides or other damage. <br />PB or PV: 3)L <br />TOPIC(S): ~ <br />Corrective action: On or before the July 12, 2006 Board Meeting, the operator must complete the - _ - <br />following actions: 1) Submit a boundary survey that clearly establishes the property boundary <br />between SW T'KO's and Tony Finley's properties, 2} Conduct a field survey of the property boundary <br />between those properties and establish adequate permit boundary markers in accordance with the <br />property boundary survey, 3) Remove all existing sediment to the extent practical from Mr. Finley's <br />property, 4) Re-vegetate all disturbed areas in accordance with the re-vegetation plan for the Lupton <br />Lakes Resource, 5) Backfill and grade and stabilize any disturbances or excavations on Mr. Finley's <br />properly created by expvators, loaders, or other heavy equipment involved in the drainage channel <br />stabilization project, and 6) Submit photographs or other evidence verifying completion of all these <br />tasks. <br />2. There was significant gully erosion in the northeast cornerlembankment of the drainage 07 / ZS /06 <br />stabilization channel, that makes the foundation of the drainage channel embankment unstable and <br />prone to further erosion during future storm events. <br />PB or PV: .39_ <br />Corrective Actions: Complete stabilization of the erosion within 30 days. Submit a plan and -- - - <br />completion report to the Division following completion of the stabilization work which describes the <br />stabilization plans and work completed. The plan and completion report must be signed and stamped <br />by a registered, P.E. with experience in drainage stabilization. The plan and completion report must <br />also include photographs or other evidence verifying completion of this work. <br />
