III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was an aerial inspection flown by the Colorado DRMS. The flight was on February 22, 2007. The <br />digital images were reviewed on February 28, 2007 <br />during the overflight. <br />Roads <br />There were no compliance problems observed <br />The road up Hubbard Creek near the mine site did not appear to have any snow on it. The entrance <br />road and the access road to Pond 5 were also clear of snow. The roads appeared to be passable. The <br />entrance gate to the mine site was closed. <br />Hvdrology <br />Sediment pond 4 was clear of snow and appeared to be dry. There was a small volume ofice-covered <br />water in pond 5. The collection ditch leading to pond 5 was partially covered in snow but appeared to <br />have sufficient capacity. The upland diversion ditch above the reclaimed coal stockpile site was free of <br />snow and appeared to be functional. <br />Reclamation <br />About half of the backfilled and graded mine site was clear of snow. The reclaimed area appeared to be <br />stable. No signs of slope instability were appazent on the benches and outslopes. There were no <br />indications of erosional gullys on the backfilled areas either. <br />The reclaimed haul road was also free of snow and showed no signs of slope instability or erosional <br />problems. <br />c:/word/blueribbon/insp0207 <br />
