<br />III. Cormrtenis - ComoZiance <br />Below are particular issues with regard to any of the above compliance items. Enforcement <br />actions resulting from failure to comply .pith the Act, P.u1es and Regulations, and the permit <br />also are identified below. <br />1. The operator was advised that pond certification, pond inspection reports and <br />NP DES reports need to be completed and available at the mine office and MLRD. <br />2. The mine has recently experienced measureable mine inflows that were not predicted in <br />the original application. Mr. Reschke was told that a technical revision needs to <br />be prepared that explains the source of the inflow, its quality and quantity and <br />any additional impacts this condition has on surface or groundwater resources. <br />3. Pits wree excavated as part of a Department of Health Spill Prevention and Counter- <br />measure Control Plan. The pits would prevent discharge of any adjacent oil and <br />gas tanks should a leak occur. <br />4. Some erosion was noted on the fill between Hubbard Creek and the Blue Ribbon Pond. <br />The erosion was minor but the operator was advised that riprap should be placed <br />along the bank later this spring when ground conditions dry out. <br />5. No drainage concerns were noted. <br />6. A small slough and associated crack was noted on the mine bench corner. No action <br />on this will be required at this time. <br />
