III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On February 19, 1997, William J. Carter from the Division of Minerals and Geology performed a <br />partial inspection of the Terror Creek Company Coal Load Out facility. At the time of the <br />inspection the weather was partly cloudy, and had warmed enough to cause a considerable <br />amount of melting of the existing snow. <br />Roads: <br />The roads in and out of the facility were in good, and stable condition. <br />Hydrologic Balance: <br />• Although the yard has been obviously graded, it contained standing water due to the snow <br />melt. This did not appear to be excessive considering the weather conditions at the time of <br />the observation. <br />The sedimentation pond contained water about two feet below the primary spillway, and <br />was not discharging at this time. <br />The culvert under the entrance road is fully functional, but should be watched to prevent <br />siltation on the upper end. <br />The ditch down gradient from the above-mentioned culvert is well below the culvert <br />outlet. <br />
