<br /> <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the Marr Strip mine and loadout was <br />performed by Christine Johnston. No one was present during my <br />inspection of the loadout and George Patterson of Kerr Coal Company <br />was available before and after my inspection of the mine site. The <br />weather during the inspection at the loadout was clear and cold. <br />It was warmer during the inspection of the mine site. There was <br />very little snow at the loadout or the mine. <br />HYDROLOGIC BALANCE <br />All ponds at the mine site were inspected and were frozen, except <br />pond C which did not have any water. The ice in all ponds was well <br />below the principal spillway. The pond at the loadout was also <br />frozen, and below the principal spillway. The ditch below the <br />facilities bench,. C-1, requires maintenance. In addition, the <br />ditch west of Pond C requires maintenance as it is on a fairly flat <br />slope and is beginning to fill with sediment. Ditch A-1 requires <br />regrading to ensure that water will continue to flow to pond A and <br />not across the reclamation. Rills were noted in an area where <br />reclamation was completed in 1983, north of pond D, along the haul <br />road. The rills appear to only be forming in the bare ground of <br />the road embankment and does not extend into the reclamation. This <br />area should continue to be inspected on a regular basis to ensure <br />that the reclamation remains stable. The outlet of the 36" culvert <br />along the haul road before the gate requires some maintenance. It <br />appears that the grade flattens and sediment is settling at this <br />point. The culvert that runs parallel to the county road and <br />crosses under the fill for the access to the Pit 1 area requires <br />immediate maintenance. The large culvert (48") at the loadout <br />which goes under the track tipple requires maintenance as it is <br />quite full. This maintenance item has been referred to the lead <br />specialist for follow-up. <br />REVEGETATION <br />The Pit 1 area has been drill seeded and at the time of my <br />inspection, two company representatives were hand seeding some of <br />the steeper slopes. The topsoil pile located southwest of the Pit <br />1 area (next to the haul road) still required seeding. There was <br />still snow in the roughened surface of the reclamation which should <br />assist with successful germination. Kerr Coal Company first plants <br />a cover crop and then the following year seeds with their approved <br />permanent seed mix. <br />006MARR.1 <br />
