<br />f <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. No one else was present. The site was covered with 6 inches of snow. <br />SIGNS AND MARKERS <br />The operator has updated the mine i.d. signs with the Division's address and phone number as <br />required by 4.30.1(3) upon temporary cessation of operations. The operator's representative, Tom <br />Petrosky ,explained in a phone conversation that he is in the process of installing a mine i.d. sign at <br />the gate leading from the Tie-across Haul Road into the truck loop area. <br />HYDROLOGIC BALANCE <br />Sedimentation Ponds <br />The truck loop pond (Pond 1) pond was approximately 30% full of water and is iced over. The pond's <br />inslopes and embankment appeared stable. <br />Ditches <br />The westernmost 75 feet of Ditch 9 still needs sediment cleaned out of it so it meets design <br />specifications, although it currently remains capable of functioning. The operator's representative <br />explained by phone that a recent clean-out effort was abandoned when the contractor warned that a <br />clean-out operation on the wet ground could possibly cause more disturbance than it would repair. <br />Consequently, the clean-out operation has been postponed until the first opportunity in the spring. <br />The operator is reminded that any offsite discharge from the ditch will result in enforcement action. <br />3- <br />
