III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted by Erica Crosby of DMG. Mike <br />Altavilla of Seneca Coal Company was present during the inspection. According to the operator, <br />roughly 5 inches of rain has fallen on site since September 18, 1997. Weather conditions were <br />overcast and raining, and ground conditions were muddy. <br />Hydrologic Balance Pond 010 contained water and was discharging. The water was clear. <br />There was no water discharging from the toe drain, but the pipe was partially clogged with <br />sediment and should be cleaned. The pond embankment was well vegetated and appeared <br />stable. Diversion ditch #2 was inspected that routes disturbed water from the facilities' area to <br />sediment pond 010. The ditch depth ranges from 3 feet to 7 feet in depth with vertical side <br />slopes. The operator is in the process of modifying the designs in TR-07. Standing water was <br />noted in the diversion, but no breaches were noted. <br />Pond 011 was being built during the inspection. A small dozer was moving topsoil down the <br />embankment slopes. The spillways have yet to be constructed. Rougly 2 feet of water was <br />noted in the bottom of the pond, well below the top of the embankment. The operator stated <br />that the embankment is roughly 18 feet high. Mike Altavilla stated that the pond will be <br />completed during the next week. The silt fence at the toe of the slope was in good repair, and is <br />functioning properly. <br />Rock has been placed in the dragline drainage area, and has withstood the recent flows from 5 <br />inches of precipitation. The ditch is lined with durable rock, and the rock blanket was visible. <br />The ditch had a nice meander and was flowing water. <br />o soil Topsoil was activly being spread along the embankment of Pond 011. No problems were <br />noted. <br />
